Extension of Postnatal Parental Leave and Extraordinary Winter Bonus for Beneficiaries.

On July 27, 2022, Law No. 21,474 was enacted, extending Postnatal Parental Leave and granting a one-time winter and extraordinary bonus to support certain beneficiaries.

i. Extension of Postnatal Parental Leave.

  • Those workers who use the parental postnatal leave, and whose right expires between May 1 and September 30, 2022, will have the right to extend such benefit after the end of the parental postnatal period, for a maximum period of 60 continuous days, which may not be extended beyond September 30 of the current year.
  • In the event that both parents are on postnatal parental leave, either of them, at the mother's choice, may make use of the referred extension.
  • If the worker has returned to work between May 1st and the enactment of this law, he/she may avail himself/herself of the benefit of the extension of postnatal parental leave by notifying his/her employer by e-mail or registered letter, which must be sent within 15 days following the entry into force of this law, with a copy to the Labor Inspectorate.
  • The extension shall be granted on a full-time basis, and the worker shall be entitled to the same allowance that he/she receives during the parental postnatal leave, and the maternity leave that benefits the worker shall be extended for the period equivalent to the extension of the parental postnatal leave.

ii. Extraordinary Winter Bonus for Beneficiaries

A one-time extraordinary winter bonus of $120,000 will be granted to each beneficiary, according to the following categories.

  1. Persons receiving family allowance and family and maternal allowance of the Unified System of Family Benefits; when they had such status as of 12.31.2021, and receive such benefit due to having a monthly income equal to or less than $907,672.
  2. Beneficiaries of the Winter Bonus granted by Article 20 of Law No. 21,405 and Article 5 of Law No. 21,419, who have received the contribution corresponding to the year 2022, according to IPS data.
  3. Beneficiaries of the Solidarity Disability Pension Contribution and Basic Solidarity Disability Pension, and who receive the contribution in July 2022, according to IPS data.
  4. Beneficiaries of the subsidy established in Article 35 of Law No. 20,255 as of June 30, 2022, and receive the contribution in July 2022, according to IPS data.
  5. Families that are users of the "Seguridades y Oportunidades" subsystem created by Law No. 20,595.
  6. Households that, as of August 1, 2022, belong to the most vulnerable 60% of the population, according to the Intersectoral Social Protection System.
